AI disclosure rules for creators in 2026

Last reviewed October 30, 2026

AI tools are part of most creators’ workflow now. The rules focus on one question: could a viewer mistake something AI made for something real?

The FTC

There is no single new FTC rule for AI. The obligation comes from the Endorsement Guides, which treat virtual and AI endorsers as endorsers, and the 2024 rule against fake reviews and testimonials. In practice, a sponsored post with realistic AI needs both an ad disclosure and an AI disclosure.

The platforms

YouTube, TikTok and Meta ask creators to label realistic AI content in the upload flow. Using AI for captions, color or cleanup does not usually need a label. Check each platform’s current help pages, because the settings change.

The EU

Article 50 of the EU AI Act applies from August 2, 2026. Whoever publishes deepfake content to the public must disclose that it is AI-generated or manipulated. If people in the EU see your content, label it.

In your contracts

Say who applies which label, and add a ban on the brand using your face or voice to train AI. Our free AI Disclosure Generator writes the labels for you.
